TERMS & CONDITIONS (Website + Service Terms)

1. Acceptance & Parties
These Terms & Conditions (“Terms”) govern your use of the Site truefixa.com and, if you engage our services, the provision of services by Goncharov Construct LLC (“Company”, “we”, “us”) to you (“Client”, “you”). By using the Site or requesting services, you agree to these Terms. If you do not agree, do not use the Site or request services.
2. Services
We provide tub-to-shower conversions, bathroom remodeling, accessibility modifications, and related handyman/construction services (the “Services”). Exact scope, price, and schedule will be set out in a written Estimate/Work Order signed by both parties.
3. Estimates & Quotes
Estimates provided are for informational purposes until confirmed in a written agreement. We may require an onsite inspection to provide a final price.
4. Payment Terms
Deposit: Projects typically require a deposit (amount to be specified in Estimate).
Final Payment: Due upon completion or as specified in the Work Order.
Payment Methods: [list e.g., credit card, check, ACH — processed via third-party processors]. We do not store full payment card data.
Late Payments: May incur interest/collection costs as set in the Work Order.
5. Cancellations & Rescheduling
If you cancel or reschedule, fees may apply if work has been scheduled or materials ordered. Specific cancellation terms will be in the Work Order.
6. Client Responsibilities
You must provide access to the property, accurate information, and notify us of any relevant issues (e.g., asbestos, permit requirements). Additional costs for unforeseen conditions may apply.
7. Permits & Code Compliance
Client is responsible for permit fees unless otherwise specified. Where required, we will advise and may obtain permits on client’s behalf; permit costs are billed to client.
8. Warranties & Disclaimers
We warrant workmanship per the warranty described in your Work Order (e.g., limited warranty).
Manufacturer warranties apply to parts.
EXCEPT AS EXPRESSLY PROVIDED, SERVICES ARE PROVIDED “AS IS” AND COMPANY DISCLAIMS ALL OTHER WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Insurance & Liability
Company carries general liability insurance. Proof of insurance is available on request.
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY’S TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE RELEVANT SERVICES. COMPANY IS NOT LIABLE FOR CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES.
10. Indemnification
You agree to indemnify and hold Company harmless from claims arising from your negligence, failure to disclose material facts about the property, or violation of these Terms.
11. Data, Privacy & Communications
By providing contact info, you consent to be contacted by phone, SMS, and email regarding estimates, service scheduling, and marketing (you can opt out of marketing). Personal data handled as described in our Privacy Policy.
12. Third-Party Suppliers & Materials
We may use subcontractors/material suppliers. We remain responsible for coordinating subcontracted work.
13. Force Majeure
Company is not liable for delays/ failures caused by events beyond reasonable control (weather, strikes, supply chain issues, pandemics).
14. Dispute Resolution & Governing Law
Governing Law: These Terms are governed by the laws of the State of Texas. TermsFeed
Venue/Forum: For disputes not subject to arbitration (if any), parties agree to venue in Travis County, Texas.
Arbitration (optional): You and Company agree to resolve disputes via binding arbitration in Austin, Texas under American Arbitration Association rules, except small claims court claims. (Modify if you prefer litigation.)
15. Termination
Either party may terminate per written terms in Work Order. Client remains liable for work completed and costs incurred.
16. Intellectual Property
Site content and materials are owned by Company. You may not reuse trademarks, logos, or copyrighted content without permission.
17. Changes to Terms
We may update these Terms. Material changes will be communicated on the Site. Continued use constitutes acceptance.
18. Severability & Waiver
If a court finds any provision invalid, remaining provisions remain in effect. Waiver of a breach is not waiver of subsequent breaches.
